Hetero-cisnormativity in LGBTQ+ Court Cases

Abstract

Judicial impartiality is the expectation of many individuals from non-marginalized backgrounds. Yet, this expectation defies the lived experiences of marginalized people. In this analysis, I test the effect of implicit bias on LGBTQ+ centric court cases and environmental court cases. I introduce a new dataset of queer and environmental judicial decisions. Based on the LGBTQ+ legal literature, I expect judicial decisions to favor environmental cases because they do not engender bias against the litigants by virtue of identity. I find judicial decisions significantly favor queer policies and homonormativity plays no significant role in court case outcome.
